In class action lawsuits, the lawyers should be paid according to the same medium of exchange that the Plaintiffs are being paid. So if 3 million Plaintiffs get $2 coupons to Netflix, then the lawyer should get their 1/3rd share in the form of $2million of Netflix coupons. If the lawyer gets cash for the plaintiffs then he/she gets paid in cash. This will increase the incentive for lawyers to get a good deal for their clients in cases of genuine wrong, reduce the incentive to file frivolous class action suits where the lawyer makes out like a bandit while the plaintiffs walk away with useless scrip. Companies should also be better off, because of fewer frivolous lawsuits even though they will no longer be able to buy their way out of suits by providing a transfer to a lawyer and useless scrip to the plaintiffs.
