Essentially this would be a way for those convicted of a crime that calls for the death penalty to waive their appeals and avoid the death penalty for agreeing to be the subject of experimental medical testing. Some murderers on death row have never made a positive contribution to society, medical testing would be a positive contribution. Medical testing on humans would be an ideal way to help more people however it is controversial for good reason but death row inmates choosing to use experimental drugs and go through experimental treatments could benefit society. Another benefit would be that if an inmate is found to be innocent they could cease all medical testing and go on with their lives.

The medical testing would have to be considered reasonably safe for humans to become test subjects, this wouldn't be a way of further punishing death row inmates only a way of giving them a chance to benefit society.

the problem would be that the constition states no cruel or unusual punishments, and experimenting on people for medical reasons as a punishment can definitly be seen as unusual.

Well, the testing would have to be considered safe. It couldn't be like giving people cancer just for the heck of it. These would have to be experiments that have been vetted by a panel of doctors and scientists. No testing could cause pain or inflict lasting damage to the person.
